Preamble
The following Terms and Conditions are concluded between, on the one hand the company Newmee, registered under the number 484 252 937 by the CS Nantes and having its headquaters at 27 Rue de la Vrière - 44240 La Chapelle sur Erdre, hereafter referred to as "Newmee" and on the other hand any person wishing to make a purchase via the Internet web site of Newmee (www.newmee.com) hereafter referred to as the "user". The parties agree that their dealings are exclusively conditioned by the present contract. If any condition should be found to be lacking it would be considered governed by the usual practices of companies in the same profession in France.
Acceptance
The simple fact of ordering merchandise on the web site www.newmee.com implies total and unreserved acceptance of our Terms and Conditions. The user agrees with all the clauses of the Terms and Conditions. His acceptance is indicated by his "electronic signature" which is made by validating an order and communicating credit card information to the Banque Populaire / Cyberplus in the case of electronic payment, or by sending a cheque in Euros drawn on a French bank for the full amount of the order. The user furthermore declares that he is able to fulfil his side of the contract.
Purpose
The present conditions are intended to define the way in which Newmee sells its products to the user, from the order, to the payment and to the delivery. They define all the steps needed to place an order, make a purchase and follow the contract through to a successful conclusion.
1. Ordering. The order is carried out on line based on the product references. The order cannot be accepted unless the user has clearly identified himself by an e-mail address and password if he is already a member, or by creating a customer account if he is not. The acceptance of the order is materialised by an order number and relevant confirmation details being sent by e-mail to the customer. The placing of the order implies agreement with the prices and descriptions of the products available on the site. Newmee promises to fill all accepted orders placed on its web site, subject to availability. In the event of a product being unavailable Newmee undertakes to inform the customer of it as soon as possible and to propose either a new date of availability for the product or a reimbursement within 30 days. Newmee reserves the right to cancel the order of a customer with whom there exists an outstanding dispute regarding the payment of a previous order.
2. Delivery Our deliveries are made by the French Postal service using the Colissimo Parcel service with tracking number for mainland France, Colissimo Outre Mer for the DOM TOM, and Colissimo International for the rest of the world. For more details see the "Delivery" page. Newmee endeavours to make its deliveries with the minimum delay. The average delay is 2 / 3 working days for France and for other countries we are dependant on the Post Office. Newmee cannot be held responsible for any delays due to the the Post Office. For deliveries outside mainland France you are importing the products ordered and any customs duties payable are at the customer's expense. The customer is solely responsible for making sure he has the right to import the products in accordance with the laws applicable in his country. 3. Returns. Newmee will reimburse or exchange any article that is defective. The customer has 48 hours from receipt of the product to contact us, either by e-mail or by telephone, in order to explain his problem and be informed of the procedure to follow for returning items. However, since our products require a certain standard of hygiene we are not able to accept any wig, hairpiece or other product that has been worn. No article can be returned without first contacting Newmee and the cost of return postage is at the customer's expense. All legitimate problems will be dealt with.
4. Right of Retraction Upon receipt of the order, for a period of 7 days, the customer has the right to retract from the contract and return the merchandise at his own expense to Newmee. It should be in its original packaging and under no circumstances have been opened. The reimbursement will be made within 30 days.
5. Payment. The customer has the choice of paying for his purchases : - on line when making his order by credit card (Carte Bleue, Visa, Mastercard, Eurocard) - by cheque in Euros, drawn on a French Bank and made payable to "SARL Newmee". For payment by cheque the customer must print the order form and send it along with his cheque to - Newmee - 27 rue de la Vrière - 44240 La Chapelle sur Erdre - France. The client guarantees Newmee that he has the necessary authorisations to make payments by credit card at the time of validating his order. None of the information regarding the credit card of the customer is kept by Newmee. Validation of the order by entering a credit card number and expiry date represents a mandate to pay the amount showing on the bill (including postage where applicable) that the secure payment site will transmit to the cardholder's bank. Newmee ensures the strictest confidentiality and security of all information transmitted on the web. For this reason we have chosen the secure module of the Banque Populaire : CyberPlus 3D Secure. The prices shown are in Euros and include VAT at the rate applicable on the day of the order. Any change in the rate of VAT can cause a change in the price of the articles, which thereafter can be altered at any time. All purchases are payable in Euros.
6. Signature and proof
Providing on line credit card information and the final confirmation of the order constitute proof of the validity of the order under the provisions of the law of 13 March 2000 and allow for the goods to be seized in the event of non-payment. This confirmation is considered a signature and implies total acceptance of all operations and transactions carried out on the site.
Responsibility
Newmee cannot be held responsible for any inconvenience inherent in the use of the Internet, such as a breakdown in the network, intrusion from the exterieur or attack by computer virus, or by Act of God as defined by the legislation.
Personal Information
Newmee reserves the right to collect information about its customers, particularly by the use of cookies.
Intellectual property All the elements of the web site www.newmee.com whether they be visual or audio including the underlying technology are protected trademarks, patents or copyrighted material. Newmee is a trademark registered with INPI under the n° 05 3352285. Integrality
In the event of one or more clauses of these conditions becoming defunct by a change in the legislation or as a result of jurisprudence, that would in no way invalidate the Terms and Conditions. Applicable law and jurisdiction
These Terms and Conditions are subject to French law. In the case of a legal dispute, and in the absence of an amicable arrangement, the litigation would be under the jurisdiction of the competent authorities of Nantes. |
